HOA Board Informs Owners of Golf Course Possible Legal Action

The HOA Board has sent a letter to all homeowners announcing threatened legal action by Morgan Creek LLC, the Golf course owners.  Thy are contending that the gates interfere with free access to the golf course and should be removed or remain open.  They also contend that the PFE gates and greeter cottage are on Golf course land and should be removed.  The HOA and its legal team are apparently in discussions with the golf course owners and believe the gates were properly installed in conformance with the easements granted to the golf course.  The board has not made us aware of the legal arguments on either side.  Anyone with specific information concerning the issues is encouraged to share it here.

Stay tuned.

July 17th HOA Meeting Report

The meeting was lightly attended with only 30 or so people present.  For those of you who didn’t attend, here are the main items discussed:

  • John Carey, Board President, announced he has accepted a new job and is working out of the area.  He is selling his home.  He intends to remain on the board until his house sells or his term expires.
The Board plans to discuss a succession plan in executive session.  No word what that will be yet.  Note:  With John’s leaving there will be three seats to be filled at the next election at the end of the year.
  • The HOA Board has received two letters from the attorneys representing the golf course owners.  They are demanding that all gates in the community be left open for golfers, wedding parties and other golf patrons.  They contend the gates impede free access to the golf course and violate their easement  They also contend they own the land containing the PFE gate.  None of this was apparently brought to light during the lengthy gate approval process.  We understand The HOA attorneys believe the golf course arguments do not have merit and  are in discussions with Morgan Creek LLC attorneys to avoid legal action.  The Board will be issuing a communication to owners explaining the situation in more detail.
  • In the forum homeowners stated they are still having difficulties with gate use at night.  Associa representative, Shelia, stated the current schedule is to have two greeters on duty from 6 am to 10 pm.  From 10 pm to 6 am there is only one and he/she is required to have breaks.  Also many residents and visitors continue to have issues operating the keypad displays and with the sound quality, especially at Walerga and PFE.    We assume the board heard and will take these issues under advisement.
  • Excessive tailgating continues to be a major problem.  No solutions were identified.

HOA Meeting July 17

There will be a regularly scheduled HOA Board meeting on Tuesday, July 17 at 6:30 pm in the golf pavilion.  As usual, it will include the members forum.  This is your chance to ask questions and express your views to the board and community on matters of interest.

From comments to the most recent Post here and posts on NEXTDOOR, there appears to still be much confusion on the gates status and operation as well as hours of operation.  Here is your chance to ask questions and seek clarification.

We you to attend if at all possible.

Vineyard Gate and 24/7 Coverage

When we voted for gates I was under the impression we were getting 24/7 manned coverage at Vineyard so anyone with a legitimate need for access could get in (golfer or on our personal lists). That meant 100% phone coverage and no sleeping or uncovered potty breaks. It looks like that isn’t happening according to the HOA. They have only one person between 10 pm and 6 am.

My story:  We travel a lot. About a month ago we called Uber for a 4 am pickup. Driver arrived at Walerga gate (per google maps) but for whatever reason was unable to get our code entered. After several tries I called the Vineyard gate for assistance. NO ANSWER!  The driver dropped the ride in frustration. A new driver was dispatched. He arrived and had the same difficulty. Running late now and frustrated, my wife drove over to the gate while I kept him on the phone. She let him in. On our return a couple of weeks ago we used Uber and had him go through the Vineyard gate at 2:05 am. There was no greeter anywhere in sight.

When we travel we often have little or no cell coverage  Even at home we often have the phone on silent.  if an emergency arose while we were gone (e. g. burglar alarm, water leak) there would be no access for family members if the Vineyard phone went unanswered.

A side benefit I thought we were getting when I voted was the second greeter could act as a rover at night for increased security when not needed as backup at the gate.

So, what do you think?  Anyone have similar concerns?  Should we have the Board reconsider, or should I suck it up and put up with the status quo?  Comments welcome.
