HOA OPEN MEETING MAKES IT CLEAR WHY A RECALL IS NECESSARY

Last Thursday an open meeting of the Morgan Creek HOA was held at Creekview Ranch School and by Zoom. The Association’s attorney, John Hanson was present to clarify his role and the Boards and to answer questions. Here are the basic facts discussed:

  • The Board’s role is much like that of any corporation. They are voted in by the community and charged with running the affairs of the Association. The Board acts as they see fit. They may or may not listen to the desires of individual or community groups. They can deceive us and act against our attorney’s advice with impunity.
  • If the community is not satisfied with Board actions, the only recourse is RECALL.
  • The Associations attorney acts as advisor to the Board. He has no control over how his advice is used. He does not deal directly with individual owners. In fact, he discouraged contact from owners as handling them will only incur charges. His ultimate responsibility is to the Board.

With regards to the 2026 budget, in her introductory remarks Stephanie once again perpetuated the lie that the budget was reviewed by the then management company, First Service, or to their knowledge any CPA. The egregious manipulation of the reserves and dues structure continues. There were numerous comments over the fairness of the dues structure.

Compliance is no longer a priority of the community. The GM will only submit violations for gross compliance issues as he goes around the community. The GM suggested neighbors submit compliance issues to help compliance. 

Regarding the Landscape Committee report, there were a significant number of projects pending when management companies were changed. These pending projects require HOA Board approval and Budget funding. Tracking these projects has been a tedious task and inaction by the management company and HOA Board majority has resulted in contractors being unable to schedule the work in a timely manner. 

The new board rules governing committees were discussed. All committee volunteers must now be reappointed every year. (Ridiculous in our opinion.) The call went out for volunteers to submit applications. A serious inconsistency was pointed out: The social committee allows for 7 members. Six are serving. There are two active applications, James Shelby and Dianne Kerr., yet the Board has refused to act in filling the vacancy. The committees seem to be populated by those that will serve the Board rather than the community, this is  based on who has been selected from the applications and who the Board did not consider and still isn’t considering This is a concern!

A new revelation: The ButterflyMX system now will require additional changes and costs. There appear to be problems with the underground wiring. Also, everyone will need new RFID tags. Two will be given “free” with others at $2 each. No implementation date was announced. The surprises keep coming.

Latest information is that only around 60 recall ballots have been returned, way short of the necessary quorum Come on people VOTE NOW!

  2. Hello – do we have an open forum site, Facebook page, etc. where various conversations can be had, but that are private to our residents?

  3. It’s weird how this is all going down. I read somewhere “this is not personal” but it certainly feels like it. Correct me if I’m wrong, but aren’t we having a normal election soon, anyway? Isn’t a recall a waste of time and effort at this point?

    1. That’s a fair question. Steven’s term is ending, but Stephanie’s is not, so a normal election doesn’t address concerns about decisions being made now or her conduct. A recall is the only way homeowners can act immediately when trust and governance issues need to be addressed.

  4. This board is way out of control and I agree that the board does appear to be acting in their own best interest.

    HUGE mistake to deprioritize compliance violations. That leaves homeowners to basically whatever they want and they will be upset if a proper board rectifies the situation and make them change to tear something out.

    The ButterflyMX RFID tags are 1″ x 2″ and are black with a butterfly on them according to their website. To me personally they seem cheap and unsightly.

    We are successfully cheapening Morgan Creek.

    1. HOAs exist to protect home values. When compliance slows or stops, that protection weakens. Some homeowners have raised concerns that enforcement has become inconsistent, including unresolved violations at board members’ homes, which understandably undermines confidence. This appears to be just one of likely many services that were reduced or removed with the new management company.

  5. Does anyone know who manages this website and sends these one-sided emails to homeowners? When I signed up for the newsletter, I thought it would share updates and tools for those who couldn’t attend HOA meetings… not be used by a few individuals to push personal agendas or attack others.

    After attending the most recent HOA meeting, I came away with a very different impression than what’s being posted here. This site and these emails should remain impartial and focus on reporting facts and recent events, not spreading accusations and/or recall efforts.

    I encourage everyone to attend meetings and form their own opinions based on firsthand information.

    For example, although my dues increased, I understand the cost-center adjustments and believe they make sense. The fact that some board members saw a reduction seems fair if they’d been overpaying for years. And as for the Butterfly Gate system… I love it and support the board’s decision to install it.

    1. We normally don’t reply to BLOG comments. However, in this case we will. In the meeting you heard rhetoric. We deal in facts.

      Read your budget. Dues were decreased not by reallocation of roads, etc. but by manipulating reserves. Mote the dangerously low lake lot reserve while other cost centers are adequate. None of this one man budget was reviewed by an accountant per our last management company. That’s a FACT we have documented. It’s not according to GAAP.

      We never said we object to the ButterflyMX system. We like it too. Fact: The capital expense was not in the budget. No one asked owners what they thought. No competing technologies were proposed. We are now experiencing significant cost overruns. We were told no RFID tag changes until now. Project was not well handled from the beginning.

      Granted, we have offered an opinion on the recall, but faced with these FACTS and many others, we felt we had little choice.

While I appreciate your engagement and the effort to clarify certain points, my main concern remains the same… this website and its emails should serve as an impartial source of updates and information for our community, not a platform for debate or promoting specific viewpoints.

    Healthy discussion and differing opinions are important, but the appropriate place for those exchanges is during HOA meetings, where all homeowners have equal opportunity to ask questions, review data, and reach informed conclusions together.

    I think most of us signed up for these updates hoping to stay connected and informed about neighborhood news and decisions… not to be persuaded one way or another. Staying neutral ensures this site remains a trusted resource for everyone in our community.

Rob, while i agree that conversations like this would be most useful in a an open HOA, however current board leadership has demonstrated that it does have an open mind to let residents voice opinions. it seem to me that there are so many agenda items on the agenda and owner opinions are not allowed to be heard. from faulty Zoom to the bum’s rush as they wanted to go home.
